Urgent notice regarding permanent and temporary residence of all people nationwide from December 15

Several new immigration-related penalties take effect from December 15, 2025.

From December 15, 2025, Decree 282/2025/ND-CP  officially took effect, stipulating a series of new penalties in the field of security, order, and social safety, especially acts related to exit, entry, transit, residence and travel of Vietnamese citizens and foreigners in Vietnam.

Fines from 300,000 to 2 million VND for common violations

According to Article 21 of the Decree, foreigners traveling within Vietnam without carrying documents will be warned or fined from 300,000 to 500,000 VND.

Many other acts are subject to fines ranging from VND500,000 to VND2 million, including:

- Failure to report loss of passport or immigration documents.

- False declaration to obtain or extend documents.

- Entering restricted areas without permission.

- Failure to present documents when requested by competent authorities.

- Foreigners overstaying their residence for less than 16 days.

- Vietnamese citizens entering the country without valid documents.

- Obtaining or possessing other people's immigration documents.

Sharp increase in fines for forging and lending documents

Violations such as erasing or altering passports; renting or lending immigration documents; using other people's documents to enter or cross the border; or accommodation establishments that do not declare temporary residence for foreigners (1-3 people) will be fined from 3 to 5 million VND.

Illegal border crossings or overstaying for 16-30 days can be fined 5-10 million VND.

Using fake passports, fake AB stamps, fake immigration documents; overstaying for 30-60 days; or accommodation establishments that do not declare 4-8 foreigners will all be fined 10-15 million VND.

The Decree also stipulates fines of VND15-20 million for foreigners working or operating in Vietnam without permission, overstaying for 60-90 days, buying and selling passports, or Vietnamese citizens using fake foreign visas.

Acts such as sponsoring foreigners but making false declarations, entering the country for the wrong purpose, falsifying documents to obtain a passport, or overstaying for 90-180 days will be fined VND20-25 million.

Maximum fine: 30-40 million VND

Particularly serious acts are subject to a fine of 30-40 million VND, including:

- Entering the headquarters of diplomatic agencies or international organizations without permission.

- Foreigners residing in restricted areas.

- Vehicle owners transporting people across the border without completing entry procedures.

- Illegal immigration or immigration brokerage but not to the extent of criminal prosecution.

- Failure to comply with deportation decisions.

- Overstaying for 1 year or more without permission.

- Crossing the border and staying in Vietnam without valid documents.

- Violations by border residents will be handled according to decrees on national border management and protection.

Decree 282/2025/ND-CP  is considered a necessary tightening step to ensure security, strictly control foreign residents, and limit document forgery and violations of immigration regulations in the context of increasing international exchange, tourism and labor.
